Due process and legal certainty are the fruit of a vision of due process in a democratic state of law in which there is an effective possibility of judicial review by the ordinary judiciary. The theory of nullity will follow this conception and will be used to ensure not only formal due process but also substantial due process. Only in a state that offers these conditions will we achieve the desired stability of the law, of constitutional guarantees, making legal stability and consequent legal certainty a reality.
